Terms of Service

1. Acceptance of Terms

Welcome to RAD Rent and Drive ("RAD," "we," "us," or "our"). By accessing or using our website, mobile application, or services (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Platform.

RAD operates a peer-to-peer car sharing marketplace that connects vehicle owners ("Hosts") with individuals seeking to rent vehicles ("Renters"). We facilitate these transactions but are not a party to the rental agreement between Hosts and Renters.

2. Eligibility

To use our Platform, you must be at least 21 years of age (or 25 for certain vehicle categories), possess a valid driver's license, and have a clean driving record. By using our Platform, you represent and warrant that you meet all eligibility requirements and that all information you provide is accurate and complete.

All users must pass a background check conducted through our partner, Checkr, before being approved to rent or list vehicles on our Platform.

3. Host Responsibilities

As a Host on RAD, you agree to:

• Maintain your vehicle in safe, roadworthy condition and comply with all applicable laws
• Provide accurate vehicle information, including photos, features, and any known issues
• Maintain valid registration, insurance, and inspection as required by law
• Complete vehicle inspections through our partner Inspektlabs when requested
• Respond to booking requests within 24 hours
• Provide a clean vehicle with at least a quarter tank of fuel at pickup
• Not discriminate against Renters based on race, religion, national origin, disability, sex, gender identity, sexual orientation, or any other protected characteristic

Earnings: Hosts receive 90% of the rental price, the highest rate in the industry. Payouts are processed within 3 business days of trip completion.

Non-Exclusive Listing: RAD operates a non-exclusive listing policy. Hosts are free to list their vehicles on other platforms simultaneously.

4. Renter Responsibilities

As a Renter on RAD, you agree to:

• Use the vehicle only for lawful purposes and in accordance with all traffic laws
• Return the vehicle on time, in the same condition as received, with at least the same fuel level
• Not smoke in the vehicle or allow pets unless explicitly permitted by the Host
• Report any accidents, damage, or mechanical issues immediately
• Not sublease, assign, or transfer the rental to any other person
• Not use the vehicle for ride-sharing services (Uber, Lyft, etc.) unless specifically authorized
• Pay all tolls, parking tickets, and traffic violations incurred during your rental period

5. Insurance Coverage

All trips booked through RAD include RAD-provided coverage. Coverage details include:

• Required Nevada liability coverage on every trip
• Comprehensive and collision coverage for the vehicle
• Uninsured/underinsured motorist protection

Deductibles may apply depending on the protection plan selected. Full coverage details provided at booking confirmation. Hosts may also maintain their own insurance, which may serve as primary coverage in some jurisdictions.

6. Vehicle Tracking

For safety and security purposes, vehicles listed on RAD may be equipped with GPS tracking devices (Bouncie or Tesla's built-in tracking for Tesla vehicles). By using our Platform, both Hosts and Renters consent to this tracking during active rental periods. Tracking data is used solely for trip verification, theft recovery, and emergency assistance.

7. Fees and Payments

RAD charges a service fee to both Hosts and Renters. Host fees are 10% of the trip price. Renter fees vary based on the protection plan selected. All payments are processed securely through Stripe. Hosts are paid within 3 business days of trip completion via direct deposit through Stripe Connect.

8. Limitation of Liability

RAD IS A MARKETPLACE PLATFORM AND IS NOT A PARTY TO THE RENTAL AGREEMENT BETWEEN HOSTS AND RENTERS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, RAD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM OR ANY VEHICLE RENTED THROUGH THE PLATFORM.

Our total liability to you for any claims arising from your use of the Platform shall not exceed the amount of fees you have paid to RAD in the twelve (12) months preceding the claim.

9. Dispute Resolution

Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the American Arbitration Association rules. You agree to waive your right to participate in class action lawsuits or class-wide arbitration.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our Platform and updating the "Last updated" date. Your continued use of the Platform after such changes constitutes acceptance of the modified Terms.
